Terms of Service
Effective from 15 September 2026
1. About these Terms
These Terms of Service ("Terms") govern your use of the ClearWorks platform: the clear-works.co.uk website and the Operations Portal, Engineer App and Partner Portal it provides ("the Platform"), operated by ClearWorks ("ClearWorks", "we", "us"). By creating an account, applying to join the engineer network, requesting a quote, or otherwise using the Platform, you agree to these Terms.
If you don't agree with these Terms, please don't use the Platform, and get in touch with us instead using the contact details at the bottom of this page.
2. Who these Terms apply to
The Platform serves three kinds of user, each covered by these Terms:
- Customers: people or businesses who request work through ClearWorks and are matched with an engineer.
- Engineers: independent, self-employed tradespeople who apply to join the ClearWorks network and carry out work for customers.
- Partners: businesses or individuals who refer leads to ClearWorks under a separate commission arrangement.
There is no public self-registration. Customer, engineer and partner accounts are created internally by ClearWorks, or (for engineers) after an application submitted through the "Join the Engineer Network" flow has been reviewed and approved. You're responsible for keeping your login details secure and for all activity under your account.
3. What ClearWorks does
ClearWorks connects customers who need gas and heating engineering work done with independent engineers who can do it, and handles the administrative work around that job (quoting, scheduling, invoicing, and payment reconciliation) through the Platform. Engineers carry out the actual work; ClearWorks is not itself a gas or heating engineering contractor.
This section describes how the Platform currently works and is intentionally general about the precise contractual relationship between ClearWorks, customers and engineers for each job. That structure should be confirmed with a solicitor before this document is relied on for a real dispute.
4. Engineers
- Engineers on the Platform are independent contractors. Nothing in these Terms, or in how work is allocated through the Platform, makes an engineer an employee, worker, partner or agent of ClearWorks.
- To join and remain active, an engineer must keep certain compliance documents current and verified, for example Gas Safe registration (or the relevant trade certification), public liability insurance, a DBS check, and photo identification. These exist because engineers work unsupervised in customers' homes, and ClearWorks may suspend an engineer's access to new jobs if a required document lapses or is rejected.
- An engineer is responsible for the accuracy of the information and documents they submit, and must tell ClearWorks promptly if anything changes: a qualification lapses, insurance is not renewed, or a circumstance affecting a DBS check changes.
- ClearWorks charges a platform fee on work booked through the Platform, set out on the engineer's weekly statement. ClearWorks may change this fee with reasonable notice.
- Engineers are free to decline a job offered through the Platform; being offered a job does not obligate an engineer to accept it.
5. Customers
- Requesting a quote does not commit you to using ClearWorks or an engineer. A quote becomes binding only once you accept it.
- Quoted prices may be confirmed or adjusted after an engineer has inspected the work in person, and you'll be told about any change before work proceeds.
- Online payment through the Platform is not yet available. Until it is, your invoice will set out how to pay by other agreed means.
- You agree to give engineers safe, reasonable access to carry out the work you've asked for.
6. Partners
Partners refer leads to ClearWorks under a separate commission arrangement agreed individually. The Partner Portal lets a partner see the performance of leads they've referred, verified revenue, and commission owed. The specific commission rate, payment terms and any exclusivity are set out in that separate agreement, not these Terms.
7. Reviews
Customers may be invited to leave a review of completed work. Reviews must be honest, based on genuine experience, and must not be defamatory, abusive, or contain another person's personal data beyond what's necessary to describe the job. ClearWorks may hide or remove a review that breaches this.
8. Acceptable use
You agree not to:
- give false or misleading information, including in a job description, a compliance document, or a review;
- use the Platform to arrange work with a customer or engineer and then take payment for it outside the Platform in order to avoid fees, once that relationship began through ClearWorks;
- abuse, threaten or harass ClearWorks staff, engineers, customers or partners;
- attempt to gain unauthorised access to any account or system behind the Platform.
9. Intellectual property
The ClearWorks name, logo, and the Platform's design and content (excluding content you supply yourself, like a job description or a document you upload) belong to ClearWorks or its licensors. You may not copy, reproduce or reuse them without our permission.
10. Disclaimers and liability
- The Platform is provided "as is". While ClearWorks checks that an engineer's compliance documents (registration, insurance, DBS, etc.) are current and appear genuine, ClearWorks does not guarantee the standard, timing or outcome of the work an engineer carries out.
- Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded or limited.
- Subject to that, ClearWorks' liability to you arising from your use of the Platform is limited as set out in any separate agreement that applies to you, or otherwise to what's reasonable and proportionate for a platform of this kind.
The liability wording above is a starting point, not finished legal drafting. The exact limits and carve-outs need a solicitor's input before this document is relied on.
11. Suspension and termination
ClearWorks may suspend or close an account that breaches these Terms, that has an expired or rejected required compliance document, or where we reasonably believe there's a safeguarding risk to customers, staff or other engineers. You can ask us to close your account at any time by contacting us.
12. Complaints
If something's gone wrong, contact us using the details at the bottom of this page and we'll look into it. This doesn't affect any other right you have, including under consumer protection law if you're a customer.
13. Changes to these Terms
We may update these Terms from time to time, for example as the Platform gains new features like online payments. We'll post the updated Terms here with a new effective date; continuing to use the Platform after that means you accept the changes.
14. Governing law
These Terms are governed by the law of England and Wales, and any dispute will be handled by the courts of England and Wales.
